This is a process by which U.S. citizens and permanent residents of the United States can apply for permanent residence for members of the immediate family (spouse, parents, children, siblings). In this case, it must be shown that the petitioner can financially support said relatives in the United States.

Who is entitled to permanent residence in the United States through relatives, and what is the estimated waiting time to obtain a Green Card?

There are two types of applicants: U.S. citizens’ family members and Lawful Permanent Residents’ family members.

Immigrate to the United States for family members of U.S. citizens

U.S. citizens can apply for family-based immigration for the following family members (please note that there may be a “waiting period” for U.S. applications and processing. Consular processing requires additional time and procedures ):

Permanent Residency for Spouse of U.S. Citizen:
This process takes 12-16 months (however, work and travel permits are issued within 4-6 months from the date each application is submitted).

Permanent Residency for Parents of a U.S. Citizen 21 years of age or older:
This process takes 12-16 months (however, work and travel permits are issued within 4-6 months from the date each application is submitted).

Permanent residency for unmarried children under the age of 21 of U.S. citizens (including stepchildren):
The process duration is 12 to 16 months (however, work permits are issued within 4 to 6 months after each permit is applied). In the case of children under 18, upon entering the United States in permanent resident status, they are eligible to apply for United States citizenship.

Permanent residency for children over the age of 21 of a U.S. citizen (including stepchildren):
The time for this process is 2-3 years, as well as a “waiting” period (usually ten years or more from the date of application).

Permanent residence for married children of a U.S. citizen (including stepchildren):
The time of this process is 2-4 years long, as well has a “waiting” period. (generally more than 15 years from the date of registration of applications).

Permanent residence for a spouse of a permanent resident:
The duration of this process is 12-16 months.

Permanent residence for unmarried children under the age of 21 of a lawful permanent resident (including stepchildren):
Duration of the procedure from 12 to 16 months.

Permanent residence for unmarried children over the age of 21 of a lawful permanent resident (including stepchildren):
Processing takes 1 to 3 years, plus an additional waiting period of 14 to 25 years.

These may vary depending on your location and the number of cases handled by the USCIS Center. Permanent Residency/Green Card applications for immigrants from certain countries such as China, India, Mexico, and the Philippines generally take longer than the above.

How long is the legal permanent residence card or family Green Card valid?

Once lawful permanent residence is approved, it is valid as long as the individual remains a resident for the majority of the time (more than 180 days per year) in the United States and meets the conditions of lawful permanent residence.

Length of family permanent residence in the United States.

Your U.S. residency status will never expire as long as you continue to meet the eligibility conditions outlined in your application. However, your Green Card (or permanent residence certificate) expires every ten years, and you must renew it at least six months before it expires.

Benefits of Permanent Residence through a family petition.

The applicant’s immediate family may be eligible for lawful permanent residence in the United States with all related benefits at the same time the applicant receives them. Legal permanent residence allows family members to legally live, study, and/or work in the United States.
